These Terms govern the relationship between 3D Menu Studio (the “Studio” or “we”) and the customer — a restaurant or other venue (the “Client”). By submitting a request, paying an invoice, or using 3dmenustudio.com, the Client confirms that they have read and understood these Terms and agree to them.
1. Services
The Studio builds and maintains digital 3D/AR menus for food-service venues. A guest scans a QR code at the table and sees the dish in 3D through the phone camera, in the browser, with no app to install. The service covers designing the branded menu, creating 3D models of dishes, hosting the menu, and ongoing maintenance.
2. Pricing and payment
Current packages and prices are published on the website. All prices are in US dollars (USD). The cost consists of a one-time menu-creation fee (payable as a deposit plus a final payment, or in installments) and a monthly maintenance subscription for packages that include it (Standard and Premium); the Start package is one-time, with no subscription. Payments are accepted by card through our payment services provider. Card details are processed by that provider; the Studio does not store or have access to full card data. Fees paid are non-refundable except as set out in the Refund & Cancellation Policy.
3. Maintenance subscription
Maintenance is billed as a recurring payment and renews automatically for a like period at the price in effect at the time of renewal, until the Client cancels. The first maintenance period is free; at its end the card on file is charged automatically through our payment services provider on the renewal date. We will notify the Client of any change in the maintenance price at least 30 days before renewal. You may cancel at any time as described in our Refund & Cancellation Policy; cancellation takes effect at the end of the paid period.
4. Client materials, rights, and warranties
To perform the work, the Client provides materials: dish photos, menu texts, logo, and brand details. The Client warrants that they hold all necessary rights to those materials and that the Studio’s use of them does not infringe the rights of any third party. The Client agrees to indemnify and hold the Studio harmless from any third-party claims, actions, and costs arising from the Client’s materials or a breach of these warranties. Rights to the final dish images, texts, and logo remain with the Client.
5. Studio intellectual property
The software platform, code, design templates, and the technology for generating and displaying 3D/AR remain the property of the Studio. The Client is granted a non-exclusive right to use the menu for the duration of the active payment and subscription.
6. Acceptable use
The Client must use the service lawfully. The following is prohibited:
- copying, reselling, or leasing the platform;
- gaining unauthorized access to data or systems;
- disrupting the normal operation of the platform;
- using the service to create, host, or distribute unlawful, misleading, or infringing content.
Violations may result in suspension or termination of the service.
7. Timeline
The typical launch time is 3–7 business days after all materials are received and the deposit is paid. This may vary depending on menu size and the quality of the source materials.
8. Warranties and limitation of liability
The service is provided “as is” and “as available”. To the maximum extent permitted by applicable law, the Studio disclaims all implied warranties, including warranties of fitness for a particular purpose, merchantability, title, and non-infringement. We make reasonable efforts to keep the menu running, but do not guarantee it will be free of interruptions caused by the guest’s device, browser, connection quality, or third-party services.
To the maximum extent permitted by applicable law, the Studio is not liable for any indirect, incidental, punitive, or consequential damages, including lost profits. The Studio’s aggregate liability on any basis is limited to the amount actually paid by the Client for the service during the 12 months preceding the event giving rise to the liability. These limitations do not apply to liability that cannot be excluded or limited under applicable law.
9. Termination
The Client may stop the service at any time by cancelling the subscription. After the paid period ends, the menu is deactivated. We may suspend or terminate the service in case of a breach of these Terms or non-payment.
10. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page with the date of the last update. By continuing to use the service after changes take effect, the Client accepts the updated Terms.
11. Governing law and disputes
These Terms are governed by the laws of Thailand. The parties will seek to resolve any disputes through negotiation; failing agreement, the dispute shall be submitted to the competent court at the Studio’s place of registration in Thailand.
12. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between the parties regarding the service and supersede any prior arrangements on its subject matter. A failure to enforce any provision on a given occasion is not a waiver of it. The Client may not assign its rights or obligations under these Terms without the Studio’s written consent; the Studio may assign them to a successor. Neither party is liable for failure to perform due to events beyond its reasonable control (force majeure).
